Terms of Service

Using AeroPacer means you accept these terms. Please read the Safety section; the rest is duller but worth a scan.

What the service is

AeroPacer takes your physiological numbers, a course profile and the race-day weather forecast, and produces a suggested power plan for the bike leg, exported as a head-unit file (.FIT), a Zwift file (.ZWO) and a printable top-tube card.

These are suggestions, not guarantees, and they are not medical or personalised coaching advice. Every calculation rests on the numbers you entered and on a weather forecast, and either can be wrong. Whether to ride to the plan, and how hard, is always your call.

Safety

• Cycling carries risk and you accept it. Obey local traffic law and event rules.
• Do not stare at your head unit to chase a power number while riding. The targets are there to be learned before the race and glanced at during it.
• If you have a cardiovascular condition, take medication, or feel unwell, consult a doctor before riding at high intensity.
• We are not liable for injury, accident or loss occurring during or after your use of the service.

Accounts

• One account per person. Keep your credentials safe; we treat activity under your account as yours.
• A coach plan lets you create and manage athlete profiles. You must have that athlete's consent and make sure they know their data is held here.
• We may suspend an account for a serious breach of these terms, and will try to give notice first.

Payment, renewal and refunds

• A race pass is a one-off purchase. Subscriptions renew automatically, monthly or yearly, until you cancel.
• You can cancel at any time through "Manage subscription" in the dashboard, which opens the Stripe customer portal. You keep access until the end of the paid period and are not charged again.
• Cancelling does not delete anything: your plans and stored CdA files remain, and resubscribing picks up where you left off.
• Prices are shown in a local currency based on the page language. US dollar prices are exclusive of tax; other currencies are shown inclusive.

Refunds (email support@aeropacer.com in every case):

• First subscription purchase: full refund if you ask within 14 days. No reason needed.
• Automatic renewal: full refund if you ask within 7 days of the charge and no new plan or FIT upload has happened in that period.
• Race pass: refundable until you download the plan files for that course. Once downloaded it counts as delivered and is not refundable.
• Statutory withdrawal rights for consumers in the EU and the UK are not limited by any of the above.

Your content and ours

• The GPX and FIT files you upload and the plans you create are yours. You give us permission to store and process them in order to run the service, including re-estimating your CdA after an algorithm upgrade. Nothing beyond that.
• The course library, the calculation engine, the site copy, the charts and the articles belong to us or our licensors. You may use and share what you generate, but you may not scrape, resell or redistribute the course library or site content.
• Some course data comes from public sources and official event information, each under its own licence.

Availability

We do our best to keep the service up, but we do not promise it will be uninterrupted, error-free or permanent. Maintenance, an upstream outage such as a weather API, or events outside our control can all interrupt it.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental or consequential loss. For direct loss, our total liability is capped at what you actually paid us in the 12 months before the claim arose. Nothing here excludes liability that cannot lawfully be excluded.

Changes to these terms

We may revise these terms. Substantive changes will update the date on this page and be emailed to signed-up users. Continuing to use the service after a change means you accept it.

Governing law

These terms are governed by the laws of the Hong Kong Special Administrative Region, and disputes fall to the Hong Kong courts. Mandatory consumer protections where you live are unaffected.
